The plaintiff brings this action to recover upon a joint life insurance policy written by the defendant on the lives of the plaintiff and his wife, Lydia Rott. Originally this policy was for $11,700 and issued on September 27, 1926. In June, 1929, the policy, upon the application of the plaintiff, was reduced to $5,850. A new policy for that amount was issued to him, but dated back to September 27, 1926, when the original policy was issued. The defendants wife, Lydia Rott, died on the 8th day of November, 1931. The sole matter in issue is whether sufficient payments of premium had been made on the policy to maintain it in force on that date.
